In 2003 the Texas Legislature completely rewrote the law in Texas applicable to negligence claims against doctors, hospitals and other health care providers. That law is found at Chapter 74 of the Texas Civil Practice and Remedies Code. This Chapter contains many provisions that apply only to protect health care providers including very specific written notice provisions, requirements for expert reports at the time of filing a law suit and limitations on damages. These new requirements have, unfortunately, made it almost impossible to prosecute some medical malpractice claims.
